Losing a loved one or a close family member provides a range of emotions and challenges. Not every person receives fair treatment under a family member’s Will. A Will may be challenged because formal rules were not complied with or because the person who made the Will lacked mental capacity or was under undue influence at the time the Will was made. A Will may be varied if the person who made the Will fails to adequately provide for the maintenance and support of their spouse or children.
